West Coast Surrogacy Is Now Licensed in New York

Published on Friday October 16th, 2026

We are excited to announce an important milestone for West Coast Surrogacy: we are now officially licensed to provide gestational surrogacy services in New York State.

As a California-based agency serving intended parents and surrogates across the country and around the world, we are always looking for ways to make the surrogacy journey more accessible and supportive. Receiving our New York license is another meaningful step in that mission, allowing us to expand our services to more gestational surrogates and intended parents throughout the state.

What Does Our New York Surrogacy License Mean?

Our new license allows West Coast Surrogacy to work with eligible New York residents under the state's surrogacy regulations while continuing to provide the personalized guidance and one-on-one support that define our agency.

For prospective surrogates, this means women living in New York can now apply to join our gestational surrogacy program. Previously, state licensing requirements prevented us from accepting New York residents into our program.

For intended parents, our license creates additional opportunities to work with gestational surrogates in New York and coordinate surrogacy journeys involving fertility clinics throughout the state. While we have long welcomed intended parents from New York, this milestone allows us to provide more comprehensive support for journeys governed by New York law.

Understanding New York's Surrogacy Laws

New York's Child-Parent Security Act, which took effect in February 2021, established a legal framework for compensated gestational surrogacy agreements. The law also introduced important protections for intended parents and surrogates, including the Gestational Surrogates' Bill of Rights.

Under New York law, gestational surrogacy arrangements must meet specific requirements, including:

  • Gestational surrogates must be New York residents or plan to deliver in New York for the agreement to fall under the state's surrogacy framework.

  • At least one intended parent must be a U.S. citizen or a lawful permanent resident who has lived in New York for at least six months.

  • Surrogates and intended parents must have separate, independent legal representation.

  • Surrogates have the right to make their own medical decisions and receive required insurance protections.

These requirements are designed to establish clear legal responsibilities and protect everyone involved. Our team can help intended parents and prospective surrogates understand the process and connect with qualified legal professionals familiar with New York's requirements.

Why New York Licensing Matters

Becoming a licensed surrogacy agency in New York involves meeting regulatory standards established by the New York State Department of Health. The licensing process includes a review of agency policies, screening procedures, informed consent practices, and other operational requirements intended to protect the rights and interests of surrogates and intended parents.

At West Coast Surrogacy, we have always prioritized ethical practices, thorough screening, transparency, and individualized care. Receiving our New York license reflects our ongoing commitment to these standards as we expand our reach.
